Property After a Joint Owner Dies in Victoria: Survivorship Application Explained
Where Victorian property is held as joint proprietors, the deceased owner’s interest generally passes to the survivor. The title must still be updated through a survivorship application.
Where Victorian property is held as joint proprietors, the deceased owner’s interest generally passes to the survivor through the right of survivorship. The title does not visibly update by itself: a survivorship application is used to remove the deceased proprietor from the register.
Confirm joint ownership first
Survivorship applies to joint proprietorship, not to a deceased tenant in common’s separate share. Obtain a current title search and do not rely only on how family members described the ownership.
A tenant in common’s share generally forms part of their estate and requires the legal personal representative pathway instead.
What the application does
The surviving registered proprietor applies under the Transfer of Land Act process to update the Victorian Register. Supporting evidence and properly verified identity details are required.
Once registered, the title records the survivor or remaining joint proprietors. This is often required before a later sale, refinance or transfer can complete cleanly.
Mortgage and electronic title issues
A registered mortgage may remain on title even though one borrower or owner has died. The bank’s loan and security requirements are separate from the survivorship registration.
Contact the lender and conveyancer early where the survivor intends to refinance, sell or change ownership.
Survivorship is not estate distribution
Property passing by survivorship generally does not pass under the deceased’s will as a title asset. This distinction can materially affect family expectations and estate planning.
Tax, pension, debt and family provision issues are beyond the title application and may require legal or financial advice.
DY practical point
Complete survivorship promptly instead of discovering the outdated title immediately before a sale. Early action also helps identify name discrepancies and lender requirements while documents are easier to obtain.
Frequently asked questions
Does the property automatically pass to the surviving joint owner?
The beneficial effect of survivorship arises on death, but the registered title still needs to be formally updated.
Is probate required for a survivorship application?
The survivorship title process is generally different from probate transmission, although the wider estate may still require probate.
What if all registered joint owners have died?
The ordinary surviving-proprietor form may not be available. The sequence of deaths and estate grants must be reviewed.
